TERMS & CONDITIONS OF E-BIKE RENTAL AND GUIDED TOUR SERVICE

 

1. Parties

This Agreement is made between: Montenegro Bike Adventures, the brand of Montenegro 4×4 Adventures d.o.o. Podgorica, with registered office at Kotorska 4, 81000 Podgorica, Montenegro, registration number 03408019, holding a valid tourism licence under the Law on Tourism and Hospitality (hereinafter: “the Agency”),
and
the individual or group named in the rental or booking confirmation (hereinafter: “the Client”).

By signing the rental contract or making payment, the Client confirms that they have read, understood, and accepted these Terms and Conditions.

2. Scope of Services

The Agency provides:

• Rental of electric mountain bicycles (“e-bikes”) and related equipment;
• Guided and self-guided cycling tours in Montenegro;
• Suggested routes with offline GPX tracks;
• Road book, only for multi-day organized tours
• Accompanying services such as helmets, chargers, locks, repair kits and route information.

All services are provided in accordance with the Law on Tourism and Hospitality and applicable by-laws regulating tourism service providers.

3. Agency’s Responsibilities

The Agency undertakes to:

• Provide e-bikes and equipment in good working and safe condition, regularly maintained and inspected;
• Provide accurate information regarding routes, terrain, and difficulty level;
• Offer Clients suggested cycling routes and offline GPX tracks for orientation;
• Ensure all guides and staff involved in organized tours are properly trained and, where required, licensed;
• Inform Clients about safety instructions, road and trail regulations, and potential risks before the start of the ride;
• Maintain basic liability insurance as required by Montenegrin law;
• Act with due care and in good faith in accordance with tourism service standards established by law.

The Agency shall not be held liable for any event or circumstance beyond its reasonable control, including but not limited to weather conditions, natural events, or third-party actions. The Agency accepts no responsibility for accidents, injuries, or damages arising from the use of e-bikes or regular bicycles, except in cases where such incidents can be conclusively proven to result from demonstrable negligence or inadequate maintenance by the Agency.

4. Client’s Responsibilities

The Client must:

• Provide valid personal identification before rental;
• Use the e-bike responsibly and only for its intended purpose;
• Wear a helmet and comply with traffic and nature protection regulations;
• Follow any safety advice or route recommendations provided by the Agency;
• Inspect the e-bike before use and report any irregularities immediately;
• Not lend, sub-rent, or modify the e-bike;
• Assume responsibility for the equipment during the rental period.

5. Duration, Return and Routes

• The rental period begins at the date and time stated in the rental contract and ends upon return of the equipment.
• The Client must return the e-bike clean and in the same condition, except for normal wear and tear.
• Late return may incur extra fees.
• The Agency provides suggested cycling routes and offline GPX tracks for navigation; these are recommendations only. The Client cycles at their own discretion and responsibility, particularly on self-guided tours.

6. Prices, Payments and Damage Deposit

• All prices are stated in euros (€) according to the Agency’s valid price list or written offer.
• Payment is due in full before the start of the rental or tour.
• A damage deposit of €100 per e-bike in cash is required prior to handover and will be refunded after the e-bike and equipment are returned undamaged and in proper condition.
• The deposit may be withheld partially or fully to cover the cost of repairs, loss, or cleaning if required.

7. Damage, Theft, Insurance and Liability

• The Client is responsible for any loss, theft, or damage to the e-bike or accessories during the rental period, except in cases of manufacturing defect or normal wear.
• In case of theft or accident, the Client must immediately inform the Agency and local police.
• The Agency’s liability is limited to the amount paid by the Client for the rental or tour, except in cases of gross negligence or wilful misconduct.
• The Client is strongly advised to hold personal travel insurance covering medical expenses, accidents, and third-party liability.
• The Agency’s insurance, where applicable, does not cover damage to the Client’s personal property or injury caused by the Client’s negligence.
• The Agency is covered by liability insurance to maximum 15,000 Euros.

8. Safety and Conduct

• Helmets are mandatory for all participants.
• The Client must not operate the e-bike under the influence of alcohol, drugs, or medication that impairs performance.
• The Agency reserves the right to deny participation or terminate the rental if the Client acts irresponsibly or endangers others.
• The Client must respect the environment, local communities, and private property along the route.

9. Cancellation and Refund Policy

For Rentals:

• More than 7 days before start: full refund.
• 3–7 days before start: 50 % refund.
• Less than 3 days or no-show: no refund.

For Guided Tours:

• More than 14 days before start: full refund.
• 7–14 days before start: 50 % refund.
• Less than 7 days before start: no refund.

10. Changes and Force Majeure

• The Agency reserves the right to adjust itineraries or cancel tours due to weather, safety, or other circumstances beyond its control.
• In such cases, the Client will be offered an alternative date, service, or full refund.
• Neither party is liable for non-performance caused by force majeure, including natural disasters, extreme weather, war, pandemics, strikes, or government restrictions.

11. Data Protection

The Agency collects and processes personal data only for the purposes of booking, insurance, and legal compliance, in accordance with the Montenegrin Law on Personal Data Protection and GDPR principles.

12. Governing Law and Jurisdiction

This Agreement shall be governed by the laws of Montenegro.
Any dispute arising herefrom shall fall under the jurisdiction of the competent court in Podgorica, Montenegro.

13. Acknowledgment

By signing the rental contract or confirming the booking, the Client acknowledges that they:

• have read and understood these Terms and Conditions;
• assume full responsibility for the use of the e-bike and participation in any tour;
• and agree to comply with Montenegrin regulations concerning tourism, safety, and conduct.
